Short Term Rental Zoning Update
August 19 HLU Committee Meeting
We are sharing an important regulatory update regarding Maui County’s ongoing rezoning process for properties currently operating as short-term rentals under the historical Minatoya list framework.
The Maui County Council’s Housing and Land Use (HLU) Committee will reconvene on Wednesday, August 19, at 9:00 a.m. to continue public testimony and discussion on Resolutions 26-129 and 26-130. These resolutions represent "Wave 2" of council-initiated rezonings, specifically addressing eligible properties within the Sea Level Rise Exposure Area (SLR-XA) and Flood Hazard Zones to transition them into the new H-3 and H-4 Hotel Zoning classifications established under Ordinance 6008.
What Property Owners & Clients Should Know
- Submitting Pending Testimony: If your property is included in Resolution 26-129 or 26-130 (or within proposed amendments) and you have not yet submitted testimony, there is still time to submit written comments or register to speak before the August 19 meeting resumes.
- Requesting Inclusion: If your property is located within an applicable SLR-XA or Flood Hazard Zone but has not been included in these resolutions, you may want to contact your Councilmember before Wednesday’s meeting to request that your parcel be considered for inclusion.
When submitting public testimony, comments should remain focused on:
- Eligibility under Ordinance 6008 criteria
- How the property meets applicable location standards
- Its established history of lawful short-term rental operations
- Support for inclusion and advancing through the rezoning process
Note: At this procedural stage, testimony is most effective when focused strictly on property eligibility and location criteria rather than broader debates surrounding long-term sea-level-rise policy or managed retreat.
Key Dates Ahead
- August 19: HLU Committee reconvenes at 9:00 a.m. to hear remaining public testimony and review proposed amendments for Resolutions 26-129 and 26-130.
- Early September: Resolutions 26-110 and 26-111 (Wave 1 rezonings) are anticipated to be formally heard by the Maui Planning Commission.
