Market Update

A new law will increase HARPTA withholding from 5% to 7.25% effective for all transactions closing on or after September 15, 2018.  The Hawaii Real Property Tax Act (HARPTA) affects sellers who are U.S. residents but not Hawaii residents.  

The law ensures that non-residents report and pay capital gains taxes when they sell real property interests in Hawaii.  There are some instances where HARPTA withholding does not apply.

Non-resident sellers are exempt from the withholding if they are conducting a 1031 exchange.  If the seller is selling the property at a loss or recognizing a gain of less than 7.25% they will not be required to have any monies withheld.  If the sales price is under $300K and the property has been used as a principal residence for the past year the seller's will qualify for an exemption from the HARPTA withholding.

P.S. - The former Maui Prince and then Makena Beach Resort is coming down piece by piece. The ballroom is mostly gone and demolition of the South wing is in progress.  This is all part of the new Makena Golf & Beach Club, a luxury condominium and beachfront community project.
