Market Update

Unpermitted Transient Vacation Rentals or illegal vacation rentals have long been a sore subject for many Maui residents and community leaders. There are strict rules in place to try to regulate the rise in illegal vacation rentals with more on the way. On November 5th at 5pm there will be a public hearing held at the Kalana Pakui conference room in Wailuku regarding an amendment to the rules relating to unpermitted vacation rentals.

Adding tougher regulations to several official Maui County documents has been in the works since the 2018 election. The County Charter was updated first and dictates that illegal vacation rental operators will receive a much higher fine if operations are allowed to continue. In the beginning of October the Maui County Code was updated as well to reflect the higher fines.

The purpose of the public hearing happening on November 5th is to update the Department’s Administrative Rules. After the public hearing, as long as there are no drastic changes to the proposed amendments they will go to the Mayor for his final approval and signature. Once he has signed the amendments they will immediately go into effect across Maui County and all unpermitted vacation rental operators will be subject to the new and substantially higher fines. The goal with these new rules is to clear out all illegal vacation rentals and bring more long-term rental units back onto the market.
