New Hotel Zoning Framework Advances in Council Committee

The Maui County Council’s Housing and Land Use Committee voted 6-1 to advance Bill 88, a measure creating new hotel zoning categories. The vote overrode the unanimous rejection of the bill by all three of the county's planning commissions.
This week, we look at the details of this legislative shift and what it means for Maui's transient vacation rentals:

Creating a New Pathway: Bill 88 introduces two new hotel zoning designations, H-3 and H-4. While it does not automatically rezone any properties, it establishes a formal process for short-term rental owners to apply for a hotel classification.

Addressing the Minatoya List: The new zones are modeled directly after current apartment standards and are designed to match the functional use of roughly 4,500 grandfathered vacation rentals on the Minatoya List.

Key Exemptions and Protections: The committee approved an amendment explicitly exempting Molokaʻi from the new hotel zones. A second amendment narrows the criteria to prevent roughly 1,700 short-term rentals not on the Minatoya List from using the new classifications as a backdoor option.

A Complement to Bill 9: Mayor Richard Bissen emphasized that the framework is intended to create a transparent, thorough public review process without reversing the Council's policy direction regarding the broader phase-out of vacation rentals in apartment districts.
The bill now heads to the full Maui County Council for its first reading.
