Although the path to this location crosses private property, the area to the makai, or ocean side, is owned by the state and held as a conservation easement to protect public access in perpetuity. According to Shai Kamaka’ala, director of 'Āina Protection and General Counsel for Hawai’i Land Trust, this easement was originally created out of a settlement agreement between the original developers and concerned community groups. In 2004, Hawai’i Land Trust became stewards of the conservation easement. Hāwea Point is an important ice box, significant to local Hawaiian families who believe the bones of their ancestors reside in the area. Habitat restoration and conservation work by groups like the Maui Nui Seabird Project also takes place in the area. While tensions between the interests of private and public users may not abate overnight, common courtesy and decency will help. All users of the area should be mindful of its cultural and historical significance and conduct themselves in a manner of respect to the land, those that came before, and to each other.
